Accredited Adjudicator Assessment

 

About the Assessment
Aim

To assess the range of skills needed in order to perform competently as an adjudicator whether in the construction field or in any of the other areas in which the CIArb offers Adjudication Schemes, and to assess your understanding of and competence in those skills.

 

Delivery

This assessment is carried out in one 3-day period.

 

Intended outcomes

On successful completion of this module you should be able to:

  • Demonstrate knowledge of the principles of adjudication
  • Appreciate the importance of managing the process of adjudication
  • Deal with procedural problems that may arise
  • Recognise the value of evidence presented

Assessment

There are three elements of assessment :

  • Assessment 1: This consists of one written exercise during the afternoon of day 1
  • Assessment 2: This consists of two oral assessment sessions during the afternoon of day 2
  • Assessment 3: This consists of one written exercise in writing a reasoned decision during the afternoon of day 3.

Who should take this module?

In order to participate, you must have:

  • Passed Module 1 – the law of contract, tort and evidence at under-graduate level, or a recognised equivalent, and
  • Completed Adjudication Module 2 – the law of adjudication, or a recognised adjudicator training course.
  • Be a construction professional, or a lawyer with a construction practice, and have been involved actively in construction projects in your primary professional role for at least 10 years post qualification, including active involvement in construction projects in your primary professional role with the last five years.

Experienced Assessors

The assessors include Assessment Director Peter Aeberli, who is an experienced adjudicator and skills assessor.

 

Timetable

2 - 4 April 2008

 

Materials

The assessment will take you through the stages of an adjudication based on a scenario that requires an understanding of contract law.

You will be provided with a copy of:

  • Part I of the Scheme for Construction Contracts (England and Wales) Regulations 1998
  • CIArb Adjudication Rules for the LB Tower Hamlets (Appendix 6 and 7)
  • CISAS Adjudication Scheme Rules for consumer disputes within the telecoms industry.

You will be required to bring a laptop so that your written work is typed. You will be required to provide electronic or printed copies of your work at the end of each workshop.

 

CPD

The Law Society and the Bar Council of England and Wales have accredited the Course for 18 hours CPD. If CPD accreditation is required for other organisations, we will be pleased to provide a Certificate of Attendance. Please ask for this on the application form.
