The CIArb’s Continuing Commitment to Mediation – London Branch IVth Annual Mediation Seminar

 

The art, science and practice of mediation have developed dramatically since the first of these seminars and, in addition, mediation is becoming more ingrained in the British way of life, whether in the commercial sector or otherwise (including the family, neighbourhood, community and other specialisms).  Mediation is growing outside the UK with the latter, particularly the CIArb, taking a lead in spreading the message around Europe and elsewhere.

 

The CIArb London Branch is consequently very pleased to have held its IVth Annual Mediation Seminar on 20 June 2007.

 

Jane Andrewartha (Clyde & Co LLP), one of London’s leading commercial mediators, addressed , from a mediator’s perspective, the question of what really happens within the process with particular reference to the principles she had learned when training in the 1990s and re-examining them in the light of her experience.  Sir Anthony Colman, formerly Mr Justice Colman addressed, in his customary masterly fashion, mediation issues as seen from the Bench with particular focus on the relationships/interfaces courts/mediation and arbitration/mediation.  David Cornes, leading commercial Mediator, addressed recent developments in the law of mediation with particular reference to confidentiality and privilege.

 

It was a particular pleasure for the Branch to welcome Sir Anthony Colman, whose landmark judgment in C&W v IBM constituted a significant development in the law surrounding mediation and whose 1996-drafted Commercial Court ADR Order continues in use to this day.  Sir Anthony was in fact the instigator of the Annual Mediation Seminar when, in March 2004, he had agreed to speak on “Case Management in Arbitration” but tore up his notes and delivered a lucid and perceptive commentary on the UNCITRAL Model Law of Conciliation which was so well-received that London Branch did a follow-up in 2005 and so on.

 

The seminar was chaired by CIArb President, Hew R Dundas, and attended, inter alia, by the Chairman of the London Branch, Nicholas Padfield QC, the Senior Vice-Chairman, Stephen Bickford-Smith, and immediate Past Chairman, David Ashton. Other attendees were London Branch members and representatives of the mediation community and hosted by Clyde & Co LLP, who generously provided a post-seminar reception at which discussion of mediation issues flowed freely.
