Disciplinary Proceedings against a Fellow of the Chartered Institute of Arbitrators
In October 2013, the Professional Conduct Committee (PCC) referred a charge of misconduct within the meaning of paragraph 15.2 of the Institute’s Bye-Laws lodged against Mr Andriy Astapov, a Fellow of the Institute, to a Disciplinary Tribunal.
The complaint lodged concerned alleged false representations made by Mr Astapov relating to the engagement of an expert in Kazak tax law arising from legal action which included an ICSID Arbitration brought against the Republic of Kazakhstan. 4 charges of misconduct were drawn up against Mr Astapov.
The Disciplinary Hearing took place on 29 May 2015. The decision of the Disciplinary Tribunal was issued on 20 July 2015.
The Disciplinary Tribunal found that all four charges against Mr Astapov had been proved and that Mr Astapov be expelled from the Chartered Institute of Arbitrators with immediate effect. Furthermore it held that he shall pay to the Institute the sum of £25,000 towards the costs incurred by the Institute.
The Board of Trustees of the Institute has the power to publish a report of any proceedings taken against or in connection with a member. At its winter meeting in 2015, the Board of Trustees resolved to publish the decision of the Disciplinary Tribunal for a period of six months or until the costs position had been resolved, whichever is the latter and to report the decision in the next edition of the Journal.
