Introduction to ADR
This course introduces professionals from different backgrounds to the burgeoning field of Alternative Dispute Resolution. The course covers a range of selected topics on the theoretical and practical dimensions of ADR. It beginsby examining the concepts of conflict and dispute from a multidisciplinary perspective. This is followed by an exploration of the notion of "alternatives" to litigation. The course concentrates on the main ADR categories, and focuses on how to identify the most appropriate method to either resolve or settle conflicts and disputes. It presents a complete explanation of the common-law response to the problems concerning access to civil justice, including costs, delays, complexities, and court congestion.
It deals with both the UK and the US background to the utilisation of ADR mechanisms, and touches upon the nascent European policy towards the development of alternatives to the court system within the EU. The course will also take a detailed look at the most well-known forms of ADR, i.e. negotiation, mediation, and arbitration, and consider when it would be appropriate to make use of them. It will also discuss the idea of developing tailor-made mechanisms for resolving and settling conflicts and disputes.
The course is delivered over 1 day. The day runs from 9.30am to 5.00pm.
