Adriaan Hoeben is a director at ENSafrica in the dispute resolution department. He specialises in various fields of commercial litigation in both the High Court and commercial arbitration.

He has acted for contractors, developers and professionals in disputes relating to residential, commercial and hotel developments. Adriaan has also acted for developers against professionals for losses sustained as a result of professional negligence in the management and oversight of the construction of commercial developments. He has frequently dealt with the insurance components which arise in these matters including enforcement or resisting demands under contractors’ performance guarantees and construction guarantees, professional indemnity cover for architects and engineers, public liability cover and contract works insurance.

In addition, he has also acted in administrative law and constitutional challenges which include, amongst others, challenging the constitutional validity of legislation, the promulgation of regulations, and disputes regarding the granting or refusal of prospecting and mining rights in terms of the relevant legislation. He has also been involved in international arbitration.

Adriaan has acted for clients in the High Court and in arbitration in contractual disputes, company law disputes, property law disputes and various other facets of commercial litigation.

Adriaan sits on the committee for the oversight and governance of the Western Cape branch of the Arbitration Association of South Africa and has extensive experience in both domestic and international arbitrations. He has assisted a number of the ENSafrica’s offices in Africa with arbitral disputes pertaining to infrastructural expansions in the countries in question.
