Challenges to Arbitration Awards

The dispute in B v A arose from a Share Sale Agreement between Spanish companies, which was written in English, but governed by Spanish law. It provided for disputes to be referred to arbitration in London under the rules of the International Chamber of Commerce. There was no other connection with England or English law.

The modernisation of international commercial arbitration

In recent decades, we have seen a dramatic increase in the volume of international trade and commerce. As disputes arising out of transnational commercial contracts also increase, there has been a corresponding growth in parties resorting to international commercial arbitration as a means of resolving disputes in a manner which is more neutral, flexible and sometimes less expensive than litigation.

The Rise of Bilateral Investment Treaties Political risk is unavoidable in any international investment transaction. Governments often reshuffle the rules of the game for legitimate and not so legitimate reasons, and this can negatively a#12;ect both the prospects for and the value of an investment.

Getting Value for Money from Arbitration - Part 2 of a 2-part series: International Arbitration

One of the most important questions that parties should ask before concluding a contract is what should the "settlement of disputes" clause in our contract be? Which is preferfable: a clause providing for international arbitration, through a body such as the LCIA or ICC,1 or a clause referring any disputes to the national court? There are strong reasons in favour of each forum including, most compellingly, the enforceability of an Award or Judgment in the paying parties' country. However, costs are almost always an important factor.

Arbitration in Australia: How Recent Reforms Have Improved the Conduct of International Arbitration and the Enforcement of Awards

Recent reforms to the International Arbitration Act 1974 (Cth) (the "Act") have increased the certainty and effectiveness of conducting and enforcing international arbitrations in Australia. The Act applies to arbitration agreements made in relation to international trade and commerce. Most of the amendments to the Act arise from the implementation of the 2006 amendments to the UNCITRAL Model Law on International Commercial Arbitration (the "UNCITRAL Model Law"). In addition, there have been a number of specific amendments to the Act designed to streamline the conduct of arbitrations in Australia.

Is Stolt-Nielsen a Game-Changer for Companies Considering the Use of Arbitration?

In weighing the pros and cons of alternative dispute resolution in the employment context, the scale often tips against the use
of arbitration agreements due to concerns such as whether the promised speed and efficiency will, in fact, materialize in
practice, as well as the unpredictability of arbitrators, the potential drawbacks of limited discovery and the extreme difficulty
in appealing arbitration decisions.

Vietnam: New Arbitration Law (Japan dispute avoidance newsletter 96(English)) (17 August 2010)

In June 2010, the Vietnamese National Assembly passed a new Law on Commercial
Arbitration (the "Arbitration Law"). This legislation, which will come into force on 1
January 2011, will replace the current Arbitration Ordinance on Commercial Arbitration of
2003 (the "Arbitration Ordinance"), which was the subject of our January 2008
newsletter. The purpose of the new Arbitration Law is to continue the modernisation of the
Vietnamese arbitration system, building on the foundations provided by the Arbitration
Ordinance. In this newsletter, we set out a recap of the dispute resolution landscape in
Vietnam, and outline the changes that the new Arbitration Law will introduce.
