CIArb and University of Salamanca launch new ADR course in Spain

CIArb News / 15 April 2010

In response to the growing demand for alternative dispute resolution in Latin America, the Chartered Institute of Arbitrators (CIArb) has joined forces with the General Foundation of the University of Salamanca in Spain

to deliver the university's first postgraduate programme in alternative dispute resolution (ADR) in the Spanish language.

The course is part of the General Foundation of the University of Salamanca's 27th Specialization Programme in Law running from 7 - 23 June 2010. This postgraduate programme is aimed at practising lawyers, judges and public officials from around the world, particularly those from Latin America and Europe.

Promoting ADR in Latin America

Julio César Betancourt, CIArb's Head of Research and Academic Affairs, said: "As the leading professional body for ADR worldwide, CIArb approached the University of Salamanca with the idea of developing a training course in ADR in the Spanish language. We are delighted to be working in collaboration with the university to help promote and facilitate ADR particularly in Latin America.

"The course will give judges, lawyers, public officials and law graduates knowledge of ADR processes so that they can advise their clients or claimants on the most appropriate method of resolving their dispute. It will also equip them with the skills to act as party representatives, arbitrators or mediators. The growth of ADR represents opportunities for attorneys and judges in Latin America, where ADR is still a relatively recent development in law practice and has not been part of the curriculum of many law schools. The development of this course at the University of Salamanca is therefore very positive."

Opportunities for skilled arbitrators and mediators

Globalisation and the expansion of international trade have driven growth in ADR. By reducing the costs and delay associated with civil and commercial litigation in court, ADR has an important role to play in increasing access to justice for many people who would otherwise be deterred from pursuing claims.

Governments across Latin America have recognised the benefits of ADR and many have enshrined it in their constitutions. Chambers of Commerce conciliation and arbitration centers, court-annexed programs and community programs all provide opportunities for skilled arbitrators and mediators.

Law Specialization Course

Developed to consolidate the University of Salamanca's relationship with Latin America, the Law Specialization course is well-established and provides high quality postgraduate training for international law graduates interested in deepening and updating their knowledge about any of the specialties offered. Since 1995, more than 6,500 graduates, including judges, lawyers, parliamentarians and officials from all Latin American countries, as well as Spain, Portugal and Italy, have benefited from the course.

The three-week course is delivered by top specialists. As well as ADR, other specialties include public procurement, current problems of constitutional law, contracts and damage and criminal law in modern societies.

The ADR programme will be directed by Prof. Dr. Eugenio Llamas Pombo and taught by leading academics with specialist knowledge of the subject. Julio César Betancourt MCIArb, an academic and mediator originally from Venezuela, will be lecturing on the subject of ADR in the Common Law; comparative and international perspectives on dispute resolution.

Membership of CIArb

On successful completion of the ADR specialist course, candidates will be able to apply for membership of CIArb, the internationally recognised benchmark of excellence in arbitration and ADR.
