Member Consultation on Arbitration Rules

Background and objective of the consultation 

Over the past decade, in response to calls for faster and more cost-effective and proportionate dispute resolution for smaller cases, many arbitral institutions have introduced expedited and cost-controlled arbitration rules. 

The CIArb has its own cost-controlled arbitration rules, the latest version dated 2014. Developments in this area and the introduction of procedures to tackle concerns over costs and delays by other institutions have prompted the Practice and Standards Committee to review and update these Institute Rules. The Committee has drafted the attached draft set. The purpose being to offer users flexible, cost and time efficient dispute resolution procedure.

The objective of this consultation is to gather input from all CIArb members with the aim of evaluating whether the issues contained in the rules are effectively and sufficiently addressed and, more importantly, whether they adequately satisfy the needs of the arbitration users.

All comments will be analysed after the deadline closes and will be used as input to decide if and where the draft rules may need improvement. It is anticipated that these will be adopted by the end of 2017 and launched in 2018.
