Mediation, sustainability and the delivery of sustainable conflict and dispute resolution
This last year has been dominated by the issue of whether mandating mediation is an effective and sustainable way to deal with the dispute resolution deficit of courts across the world. After a brief overview of sustainability and mandatory mediation, in-person attendees will be invited to join working groups, moderated by experienced mediators. These will focus on mediation issues including the mandatory mediation consultation in England and Wales (which closes on 4 October), technology and sustainable mediation delivery, and mediator skills relating to issues of sustainability and sustainable development.

Niki Borofsky is a Senior Global Practice Manager at JAMS Local Solutions. She is based out of New York, and responsible for business development, panel relations, thought leadership, and strategic marketing in regions including Europe, North America and the Middle East. She works to help promote Mediation, Arbitration, and other Alternative Dispute Resolution services, increase global understanding and use of JAMS’ International Arbitration and Mediation Rules and Procedures, and build business for JAMS panellists who have global practices. She is the Chair of JAMS’ In-House Counsel Committee dedicated to providing effective dispute mitigation and resolution solutions to corporate counsel worldwide. Prior to joining JAMS, Ms. Borofsky worked as an international attorney in academia, business, and law firms including positions at the University of Paris II Panthéon-Assas, ALSTOM, Latham & Watkins, and with Proskauer's International Arbitration group where she focused on complex international commercial arbitration and counselled multinational corporate clients on cross-border disputes. She also worked as Vice President of Membership Services at the International Institute for Conflict Prevention and Resolution (CPR) where she was responsible for planning and executing the organization’s Annual Meetings. A member of the New York and Massachusetts bars, and with an LLM in French and European Law from the University of Paris I Panthéon-Sorbonne, Ms. Borofsky has authored several articles on global dispute resolution. She is also New York Peace Institute trained mediator, and has participated in training members of the NYPD in peaceful conflict resolution. Dedicated to improving Diversity, Equity, and Inclusion in ADR, Ms. Borofsky is a Founding Member of the ADR Inclusion Network. She is a Board Member of the Latino Judges Association Foundation and a convener of the monthly ACR-GNY and CUNY Dispute Resolution Center at John Jay College Breakfast Roundtable.
Catherine joined CIArb as Director General in May 2020 having set the world record for circumnavigation of the world on a tandem. Prior to setting her world record, Catherine spent time in Chief Executive Officer roles at the Law Society of England and Wales, a Higher and Further Education College and at NHS Resolution. Catherine has also held Senior Executive Director and General Counsel roles at the NSPCC and BUPA and in Canada at Vancouver Coastal Health Authority.
Catherine started her professional career in private practice as a solicitor, at Eversheds Sutherland and was an Officer in the British Army. Catherine has served as a trustee and non-executive director on a number of boards, including the Centre for Effective Dispute Resolution (CEDR), Queens Counsel Appointments, LawWorks, National Pro Bono Centre, the PDSA, the Yorkshire and Humber Local Enterprise Partnership, the Yorkshire Chamber of Commerce, Landex and was the Deputy Chair of the IBA LGBTQI Committee. Catherine is currently a trustee of Stonewall and a member of the Advisory Board of the Open University. Catherine is a solicitor and accredited mediator and has a MBA.
Mike serves as arbitrator, mediator, and professor. As an arbitrator he has rendered nearly 50 awards in both New York and in London and has been a sole arbitrator, a wing and an emergency arbitrator. As a mediator he has mediated several dozen cases, many to settlement.
For seven years before turning to full time dispute resolution he was Deputy General Counsel of a major financial services company, with global responsibility for litigation and arbitration, employment, IP and other areas. He managed all legal support for its affiliated public company.
He lived in London one-third of the year and travelled to several other countries including Hong Kong and Brazil to manage matters there. He still travels frequently, COVID permitting. For 30 years before going in-house he was a full time commercial litigator handling a wide range of cases, including claims by and against countries.
Mike is a Fellow of the Chartered Institute of Arbitrators (CIArb) and has its Diploma in International Arbitration. He's a CEDR Accredited Mediator, after completing the Center for Efficient Dispute Resolution's (CEDR) advanced mediator training and evaluation. He earlier completed the American Arbitration Association's mediator and arbitrator trainings.
Mike is on the mediation and commercial arbitration panels of the American Arbitration Association and the panels of distinguished professional arbitrators and mediators of CPR- the International Institute for Conflict Prevention and Resolution and sat on an LCIA Tribunal. Mike has also been listed by the World Intellectual Property Organization (WIPO) and the Court of Arbitration for Art (CAFA) both as a mediator and as an arbitrator. Mike is on the mediation panels of the U.S. District Courts of the Southern District of New York and for the District of New Jersey. He is a member of the ICC/USCIB and the Silicon Valley Arbitration and Mediation Center (SVAMC). He is listed as an arbitrator and mediator by the American Intellectual Property Association. He has rendered awards for the International Centre for Dispute Resolution (ICDR) and HuntADR.
Mike is a member of several bar-related groups concerned with arbitration and mediation in New York. He was secretary of CIArb's NY Branch and is web curator of the International Arbitration Club of New York. He has spoken several times on ADR and authored several articles. Mike has judged Vis pre-moots and the moot for several years Mike teaches a course on in-house counsel at Hofstra Law School, Autumn semesters.
Isabel Phillips is Director of ADR and Mediation Development at CIArb. Isabel is a conflict specialist and mediator with 25 years of experience. This experience includes mediating a wide range of commercial disputes and several years mediating and delivering dialogue programmes in fragile and post-conflict environments internationally. She has consulted on, and designed, dispute and conflict management systems, mediation, negotiation and conflict training solutions for governments, IGOs, NGOs and commercial businesses. She is a German-qualified conflict specialist (FFK), a CEDR accredited mediator and was awarded a PhD for her work on the practice and theory of commercial and socio-political mediation.
PhD in International Law and Master in Economic and Financial Law, University of São Paulo Faculty of Law. Specialist in negotiation and dispute resolution at Harvard Law School. Fellow of the Chartered Institute of Arbitrators (FCIArb) and CIArb Brazil Branch Honorary Secretary. Certified mediator by the CPR - International Institute for Conflict Prevention and Resolution (CPR Neutral) and by the CDER - Center for Effective Dispute Resolution (CEDR Neutral). First Secretary of the Commission on Consensual Means of Dispute Resolution of the Brazilian Bar Association, São Paulo section. Former coordinator of the AASP Mediation Center, awarded with the prize “Mediar é Legal” in 2017, granted by the National Council of Justice, Brazil.
Tim Marshall was called to the Alberta Bar (Canada) in 1986 and has been a Member of the Bermuda Bar since that time. He has been a Fellow of the Chartered Institute of Arbitrators since 1999. Mr Marshall is the cofounder of the Bermuda law firm, Marshall Diel & Myers Limited (“MDM”), and served for many years as its Managing Director. On 31 December 2020 Mr Marshall retired from MDM in order to pursue new adventures. His professional focus going forward is serving as an arbitrator and mediator. He formed TZM Legal Consultants in 2021 to facilitate this area of work.
Mr Marshall has 35 years of experience as a Barrister, practicing before Magistrates’ Court, Supreme Court, Court of Appeal, various administrative bodies and arbitration tribunals. His practice has been primarily in the area of civil litigation where he has appeared on a wide variety of matters for individuals and companies, ranging from numerous employment disputes, regulatory and disciplinary matters, residential and commercial property disputes, personal injuries, human rights and constitutional challenges, company and shareholder disputes, telecommunication cases and international trust reorganizations and family disputes.
In 1992 Mr Marshall was appointed by the Chief Justice as an acting Magistrate and periodically presided over criminal and civil cases. Since 1999 he has been regularly appointed as an examiner, arbitrator or mediator in a variety of disputes and has been regularly appointed by the Bermuda Government and professional bodies to serve as the Chairperson or legal/public representative of a wide variety of tribunals, commissions and boards. From 2014 to 2017 he served as the Chairperson of the Immigration Appeals Tribunal, co-authored the Rules for the Tribunal and thereafter presided over numerous appeals involving decisions made by the Minister of Immigration. He most recently has been involved in representing a professional body and a regulatory body in disciplinary and compliance cases.
David Kreider is a leading arbitrator of technology, IP licensing and financial disputes. A U.S. trained trial lawyer, David went in-house as the Head of Legal at telecom giants China Mobile and Vodafone, for 15 years. He was among the first to be included on the general and specialist panels of IP arbitrators of both the Singapore International Arbitration Centre and the Hong Kong International Arbitration Centre. David has presided over significant IP licensing disputes in Asia and the U.S., as chairman, sole arbitrator, and co-arbitrator, and has been appointed panellist, expert or examiner in more than 200 internet domain name disputes. He speaks Chinese as a second language and is a licensed solicitor and attorney-at-law in England, Hong Kong, New York, New Jersey, California, Florida, and Washington, D.C.
Gary Birnberg is an arbitrator and mediator specialized in cross-border commercial disputes, including matters involving aviation, insurance/re-insurance, sports/entertainment, financial industry, art, and life science. A Fellow of the Chartered Institute of Arbitrators, a Distinguished Fellow of the International Academy of Mediators, and Fellow of the International Academy of Distinguished Neutrals, he has completed over 500 cases with aggregate value of billions of Euros. Gary is associated with JAMS and affiliated with, and/or has worked on cases administered by some fifteen other institutions worldwide, including CAM-CCBC, ICC, ICDR, and the Hague Court of Arbitration for Aviation, of which he is Chair of the Board of Advisors. Past Co-Chair of the IBA Mediation Committee, and CIArb Chapter Chair (Florida, North America Branch), his work as an arbitrator and/or mediator has been recognized repeatedly by multiple publications, including Best Lawyers in America and Leaders League (Brazil). He holds degrees from INSEAD, University of Pennsylvania, and Boston University School of Law and has been admitted to four bars in the USA. He works in English, French, and Portuguese.

Yoshihiro (Yoshi) is the Executive Director of Japan Arbitrators Association; Co-Convener of Japan Chapter, Chartered Institute of Arbitrators (CIArb); Chair of Web Hearing Committee, Japan International Dispute Resolution Centre; Arbitrator at the Singapore International Arbitration Centre, Japan Commercial Arbitration Association and Korean Commercial Arbitration Board; and Japan Expert Mediator at Singapore International Mediation Centre. He was the only Japanese lawyer in Financial Times’ top 10 legal innovators for Asia-Pacific region 2019. He was ranked a Band 1 dispute resolution (DR) lawyer by Chambers, and named a Leading Lawyer by Legal 500. After heading the DR practices at the Paul Hastings and Orrick Tokyo Offices, Yoshi established the International Arbitration Chambers at KILO in May 2020. He conducts training for Japanese judges on international alternative DR, including standard-essential patents DR, requested by the Japanese Government and various Bar Associations. Yoshi is admitted to the New York and Japan Bar, and is a CIArb Fellow.
Mahamed was an Associate Professor at UNISA's Graduate School of Business Leadership. From 1980 to 2016 he lectured in labour law, negotiation and conflict management, industrial relations and dispute resolution. He was editor of the South African Journal of Labour Relations, published widely, contributed to books and edited several seminar proceedings. Mahamed Rajah is a part-time Senior Commissioner at the CCMA and serves on the CCMA collective bargaining panel. Mediates redline disputes of National importance. He has worked for more than 30 years in the mediation and arbitration arena and has extensive experience in chairing disciplinary hearings and as a bargaining forum chairman, facilitator, mediator, arbitrator, trainer and relationship-building facilitator. Mahamed has been actively involved in training and capacity building over the years. He consulted for the International Labour Organization's project to train staff of the South Africa Department of Labour. He co-trained on the labour mediation course at ILO training college in Tunis, Italy. He was one of the trainers of the first batch of Commissioners when the CCMA started. He trains, coaches and assesses candidate Commissioners at Wits University and serves as assessor at Stellenbosch University. Mahamed was privileged to act as a judge at the ICC international mediation competition in Paris. Mahamed is a Centre for Effective Dispute Resolution (CEDR, UK) accredited commercial mediator, coach and assessor. He was trained at the Advisory Conciliation and Arbitration Service (ACAS) in Britain. He is also a Mediation Training Institute International (MTI) certified consultant in workplace mediation. Before joining UNISA, Mahamed was an employment consultant and an instructor at the Iranian Air Force Language Academy. Served as Editor of the South African Journal of Labour Relations. Published several articles and research reports and contributed to and edited books.
Marcelo Perlman is a commercial mediator based in Sao Paulo, Brazil. He is a Distinguished Fellow of the International Academy of Mediators (IAM) and has been included in the Panel of Distinguished Neutrals of The International Institute for Conflict Prevention & Resolution (CPR), from New York, as well as in the rosters of mediators of different reputable Brazilian and Portuguese providers. His mediation practice has been recognized in the rankings Commercial Mediation 2022, published by Who's Who Legal, Mediators - Brazil – 2021 and 2022, published by Leaders League, and the 2021 Lexology Client Choice Awards for Mediation in Brazil.
Myrna Barakat Friedman is an independent commercial arbitrator and mediator with over 25 years’ experience advising senior executives and leading domestic and cross-border transactional matters. She is a Fellow of the Chartered Institute of Arbitrators and a New York State-Certified Mediator. Myrna brings to her ADR practice a unique mix of legal, corporate and business experience. She has led transactions globally as a Wall Street M&A and securities lawyer, a lead in-house M&A lawyer for a Fortune 500 Company, a Corporate Development executive and the founder of a boutique strategic growth initiatives’ advisory company. Her multifaceted career spans across industries and jurisdictions. Myrna is trilingual- English, French and Arabic, and has a working knowledge of Spanish. She is a graduate of McGill University’s Law School, where she earned degrees in both common law and civil law, and McGill University’s School of Management, concentrating in Economics and Finance.
John Bassie is the Deputy President in 2022 and will be the Global President in 2023. He is called to the bar in England and in Jamaica. In addition to being a former Council Member of the General Legal Council, he was the chairman of its subcommittee with responsibility for the formation of the Compensation Fund. Mr. Bassie is the current Vice President and formerly served Treasurer of the Jamaican Bar Association and he is also Chairman of the ADR Committee. John is the Founder of the Caribbean Branch of the Chartered Institute of Arbitrators (2009) and the first Chairman of the Branch. He is also Chairman of the Board of the Dispute Resolution Foundation, which is the oldest ADR organization in the Caribbean region, having just celebrated 25 years of service to the industry. He is a Chartered Arbitrator, Certified Tutor of the Chartered Institute of Arbitrators and a Certified Mediator of both the Supreme Court of Jamaica and the Supreme Court of the State of Florida.
Hiro N. Aragaki, C.Arb, is a dual-qualified (U.S. and U.K.) international arbitrator and mediator at JAMS. He has served as a neutral for almost twenty years, with substantial experience in commercial, banking & finance, technology, and entertainment disputes. He is also a tenured Professor of Law at U.C. Hastings College of Law in San Francisco, and a Professorial Research Associate at SOAS School of Law in London. He has frequently been called upon to train judges and consult on ADR reform projects around the world, most recently as an Advisor to the Expert Committee on Mediation, Supreme Court of India, as an Advisor to the judiciary of Kazakhstan regarding arbitration law reforms, and as a mediation expert for the World Bank’s new Business Enabling Environment Report. He is a Chartered Arbitrator with the Chartered Institute of Arbitrators (U.K.), a Fellow of the College of Commercial Arbitrators (U.S.) and holds degrees from Yale, Stanford, and Cambridge.
Ximena Bustamante is founding partner of PACTUM Dispute Resolution Consulting and a full time mediator with experience in over 1.000 cases, including highly complex disputes and controversies with the public sector, both in Ecuador and abroad. She is a Professor at San Francisco de Quito University and has taught several courses and seminars on mediation both in Ecuador and internationally. Ximena was ranked as one of the top three mediators of the country by Leaders League in 2021 and 2022. She is senior fellow for the Weinstein International Foundation, Membership Officer of the IBA Mediation Committee, neutral for the United Nations Global Mediation Panel, neutral for ICSID’s Conciliator Panel, part of the Expert Group on Mediation at the UNCITRAL, and member of the Mediator Designation Commission for the Madrid International Arbitration Center – MIAC.
Mauricio Gomm Santos serves as counsel, and predominantly as arbitrator in arbitration proceedings before major international providers in the field of commercial contracts in general. He also serves as a mediator. Mr. Gomm Santos is admitted to practice law in Brazil, New York, and, as Foreign Legal Consultant, in Florida. He serves as an expert witness in matters regarding Brazilian law before arbitral tribunals and judicial courts. He holds an LLM. in Private Law at the Federal University of Paraná, Brazil (1985), an LL.M from Queen Mary University of London with a focus on International Commercial Arbitration (1993), and an LL.M from the University of Miami, School of Law in International Comparative Law (2006). Adjunct professor at the University of Miami, School of Law, teaching "Arbitration in Latin America" from 2007 to 2010. Lizbeth Hasse has served as mediator, arbitrator, negotiator, or special master in over a thousand matters in the United States and internationally since 1998. Ms. Hasse has practiced in the areas of intellectual property and commercial litigation and international business negotiation since her graduation from the University of California, Berkeley School of Law. A neutral JAMS panelist, Ms. Hasse provides her services as a resolution expert from the JAMS California and New York offices, as well as mediating and arbitrating cases throughout the world. Bringing 30+ years of international experience in intellectual property, business operations, entertainment/media, and technology law, Ms. Hasse has proven sophistication to manage a wide range of commercial disputes as well as mediating international human rights disputes in business practices areas.
Ms. Hasse founded the Intellectual Property and Entertainment law firm of Creative Industry Law in San Francisco in 2003. Prior to that time she practiced with Coudert Brothers LLP, Steinhart & Falconer, and Heller, Ehrman, White & McAuliffe. She is a graduate of Wesleyan University and received a Master’s degree in Jurisprudence and Social Policy and a Juris Doctorate from UC Berkeley. As visiting faculty, she has taught intellectual property, civil law, comparative law, media law and legal theory at UC Berkeley, University of Paris V, France and American University, Yerevan, Armenia. She has lectured at law faculties in Denpasar, Indonesia; Dakar, Senegal; Tartu, Estonia; Moscow (VGIK), Russia; Astana, Kazakhstan. Hasse is fluent in English and French and has functional knowledge of German and Russian. She is a Fellow with the Chartered Institute of Arbitrators and researched comparative law in Paris as a Fulbright Fellow.
As a mediator, Ms. Hasse has settled many types of complex actions with an aggregate value in the billions of dollars, including antitrust class actions; securities class actions; intellectual property and trade secret actions; consumer class actions in the banking and healthcare sectors; environmental cases; litigation with bankruptcy elements; entertainment, technology and sports disputes; insurance coverage claims; human rights matters; international disputes involving environmental claims; and Alien Tort Claims actions. Ms. Hasse has assisted with joint venture negotiations on four continents in technology, telecommunications, entertainment, and health industries. Ms. Hasse has also advised on legislative projects in IP, media law, cultural and constitutional areas in a number of Eastern European, Asian and African "countries in transition," working for foundations and professional organizations.

He is the author of three books: “ADR and Community Justice” in 2003, “Indigenous Law, conflict and Community Justice within Kichwas communities in Ecuador” in 2007, and “Organic Law of Cooperation and Coordination between Indigenous Law and Ecuadorean Law: a necessary constitutional rule or a norm that restricts the Indigenous Law?” in 2012.
