CIArb Taiwan Chapter’s Evening Talk on Hot and Emerging Legal Topics in Climate Change

The Taiwan Chapter was very honored to co-host, along with the Chinese National Federation of Industries, the Taiwan Impact Investing Association, and the iADR® on 21 October 2021 a special evening talk on “Hot and Emerging Legal Topics in Climate Change” through a virtual meeting.

Dr Helena Chen FCIArb (Convenor of the Taiwan Chapter, Senior Partner of Chen & Chang, Attorneys-at-Law) first invited special guest, Mr David Tawei Chang (Chair of Taiwan Impact Investing Association), to give welcome remarks, followed by the playing of a welcome video by special guest, MsEmily Chiu (Deputy Secretary General of Chinese National Federation of Industries), pre-recorded for this event. A third special guest, Ms Alison Chang of FCIArb (former Head of the Taiwan Chapter YMG, North Asia Representative of the ICC YAF), then encouraged all of the attendees to explore the possibilities of the use of arbitration in the emerging field of energy disputes.

The talk was then organised into three parts, with each keynote speaker sharing his/her experiences, insights, and advice on one specific topic. Dr Pijan Wu FCIArb (Senior Counsel at LCS & PARTNERS) presented the topic “When Ms Energy Meets Mr. Carbon”, which talk sought to prepare the businesses for the low-carbon economy.  Prof Wen-Chen Shih (Professor at College of Commerce, National Chengchi University) discussed the development of and draft regulations on the establishment of a Carbon Border Adjustment Mechanism (CBAM). Dr. Helena Chen FCIArb (Senior Partner of Chen & Chang, Attorneys-at-Law) described the prevailing structures of Corporate Power Purchase Agreements (CPPA) and identified pre-contractual challenges frequently encountered by interested parties in CPPA transactions as well as key issues for negotiating a CPPA. The talk was concluded with an enthusiastic Q&A session.

Significant progress on Advisory Centre for International Investment Law at UNCITRAL

In 2017, UNCITRAL Working Group III (WGIII) was launched and was tasked with working on procedural reform of the investor state dispute settlement (ISDS) system. From 1-5 April 2024, Ciarb participated in the 48th session of WGIII in its capacity as an observer delegate.
