Maksym Kodunov is an international disputes specialist whose experience spans across many aspects of international arbitration and cross-border litigation and includes investment treaty claims, shareholder and post-M&A disputes (often involving allegations of fraud), construction disputes arising out of FIDIC contracts (disputes board and arbitration). He has been involved in arbitrations under the ICSID, ICC, LCIA, SCC, VIAC, GAFTA, FOSFA, Ukrainian ICAC Rules, ad hoc arbitrations, and in related applications in the courts of England, US, BVI, Cyprus, Russia, Switzerland, and other jurisdictions.

In 2015 to 2020, Maksym was Director of International Dispute Department of the Ministry of Justice of Ukraine, in charge of representing the State in international arbitrations (primarily defending investment treaty claims) and foreign litigations (often involving aspects of sovereign immunity). As a part of his responsibilities in the Ministry, Maksym was also involved in drafting Ukraine’s bilateral investment treaties and led Ukraine’s delegations in the UNCITRAL Working Groups II and III and in negotiations on the new suite of the ICSID Rules.
