I am a senior civil engineer and construction contracts, claims and disputes specialist with more than 30 years of professional experience in major infrastructure projects, including over 16 years as an independent consultant.
My experience spans construction contract administration, claims and dispute resolution from the perspectives of the Employer/client, Engineer/Employer’s Representative, contractor/adviser and neutral decision-maker. I have extensive experience with FIDIC-based contracts, including Red Book/admeasurement, Design-Build, Plant & Design-Build, EPC/Turnkey and MDB Harmonized forms, as well as bespoke and domestic contracts.
My principal areas of practice include construction contract management and interpretation; preparation, assessment, defence and determination of complex EOT and financial claims; variations; contractual risk assessment; and dispute avoidance and resolution. My claims experience includes delay, disruption, acceleration, prolongation, suspension/idling, termination, Force Majeure, Employer’s Risks, unforeseeable conditions, payment issues, price adjustment and changes in legislation.
I advise contractors, Engineers and Employer’s Representatives on complex contractual, claims and dispute matters, including DRE/DRB/DAB proceedings, arbitration and negotiated settlement. I have also prepared and advised on Engineers’/Employer’s Representatives’ determinations of contractors’ claims and contractual entitlements.
I also serve as an arbitrator and Dispute Review Expert (DRE), with appointments as Presiding Arbitrator, Sole Arbitrator, member of a three-member arbitral tribunal and DRE on major infrastructure projects. I am a Fellow of the Southern Africa Association of Arbitrators (FAArb) and a Member of the Chartered Institute of Arbitrators (MCIArb).
I hold an M.Sc. in Construction Management with Distinction from Loughborough University (UK), where my studies included Contract Law and Construction Law. My subsequent arbitration qualifications included formal study and examinations in International Arbitration, Law of Contract, Tort/Negligence and Law of Evidence.
Earlier in my career, I held senior contract-management positions with the Ethiopian Roads Authority and subsequently served as Infrastructure (Transport) Specialist with the African Development Bank.
