Business-Forward Legal Solutions. This is what I bring to commercial dispute resolution. Commercial disputes with legally informed management that puts business objectives forward requires direct experience of business concerns and objectives buttressed with sound legal foundations.
I bring over 35 years of business experience as an investment banker, investment manager, principal investor, company director and business owner. My direct experience as principal party include:
• Project finance, investment banking, syndications banking, commercial banking
• Project development, EPC, O&M and offtake contracts in infrastructure
• Real estate development and investment, REIT management
• Private equity investment
• Hotel development and investment, hospitality and retail branding businesses
• SME investments, supply chain investments and impact VC
• JVA negotiation, implementation and dispute management
• Managing and conducting investment litigation as principal party
This experience was gained mainly in my Asia-Pacific home market, as well as in business engagements in Australia, US, Europe and the Middle East.
With this background, I know from personal experience that disputants first and foremost need a business solution. And they wish to achieve this with the most P&L-friendly method and forum for each dispute. Case-by-case this may include appropriate use of variations of Arbitration-Mediation-Arbitration (Arb-Med-Arb), in which I understand both the Arbitration and Mediation components.
My business experience is supported by the requisite legal training:
• as Barrister of England & Wales
• in arbitration and dispute resolution (Fellow of the Chartered Institute of Arbitrators)
• in mediation, relationship preservation and consensual dispute resolution (Specialist Mediator of the Singapore International Mediation Centre)
In addition, I have first-hand experience in negotiating, drafting, documenting and executing commercial contracts both as principal party as well as professional advisor. I am deeply familiar with regulatory compliance as an Accredited Director of the Singapore Institute of Directors and former director / shareholder in regulated financial institutions in different international jurisdictions.
As an active advocate of business-forward legal solutions in both the law and business communities, I have been privileged to present commercial perspectives for lawyers on large project disputes and IP disputes at AAA-ICDR and WIPO/IPOS events.
