Party-Appointed Expert Witnesses in International Arbitration: Effectiveness and Best Practice
Party-Appointed Expert Witnesses in International Arbitration: Effectiveness and Best Practice

Expert witness evidence is a critical component of contemporary international arbitration. Tribunals routinely depend on expert input to address complex technical, financial and scientific matters, and the quality of this evidence frequently influences the outcome of proceedings.
As arbitration grows in scale and complexity, it has become increasingly important to ensure that expert evidence is prepared, presented and tested in a manner that supports the efficient, fair and informed resolution of disputes. At the same time, practitioners continue to observe recurring challenges—including late expert engagement, insufficient communication, and a lack of clarity in the presentation of expert analysis— that can diminish the usefulness of such evidence.
This report has been developed in response to these concerns. It forms part of Ciarb’s initiative Maximising the Effectiveness of Party‑Appointed Expert Witness Evidence in ADR, launched in 2024, and builds on Ciarb's longstanding commitment to thought leadership in this field.
