International arbitration is evolving rapidly, and with it, the boundaries of the arbitrator's role are being tested and redefined. How proactive can an arbitrator be before robust case management becomes overreach? How much disclosure is enough, and when can disclosure itself create unnecessary challenges? What does due process require when efficiency and procedural economy are also at stake? How should tribunals respond to aggressive counsel conduct? And perhaps most urgently, where should the line be drawn on the use of artificial intelligence by arbitrators, counsel, experts, and institutions?
This panel will explore the emerging "red lines" of international arbitration through practical scenarios and competing perspectives. Panelists will examine the difficult judgment calls arbitrators increasingly face: using AI in researching, drafting, or analyzing a case; determining what relationships or circumstances require disclosure; balancing procedural fairness against efficiency; intervening, or choosing not to intervene, in counsel conduct; and exercising procedural discretion without compromising neutrality or the enforceability of the award.
Rather than focusing only on what arbitrators can do, the discussion will ask the more challenging question: how far should they go? Through real-world hypotheticals and audience engagement, the panel will identify where accepted practice ends, where legitimate discretion begins, and where arbitrators may risk crossing the line.
Following the panel, we invite all attendees to join us for our Holiday Cocktail Reception a festive opportunity to continue the conversation, connect with colleagues and friends from the international arbitration community, and celebrate the holiday season together.
