Ciarb UAE Branch Mediation
There is a growing demand for mediation by parties seeking to resolve their disputes amicably under contracts in the UAE. To support this requirement in dispute resolution, the UAE Government has issued the Mediation Law (Federal law 6/2021, Minister Decree 546/2022 and Federal law 40/2023). Arbitration centres have recognised parties' interest in mediation as an effective and efficient means of alternative dispute resolution.
The Ciarb UAE Branch supports the promotion of mediation through education and training of Ciarb members. The Ciarb has compiled a list of Ciarb members in the region who are accredited mediators that contracting parties, legal counsel or appointing bodies may utilise to identify a suitable neutral mediator to assist in settling their dispute.
Ciarb UAE Branch will not be appointing mediators directly as this function is reserved to Ciarb’s Dispute Appointment Service (DAS), but this list will be an important database for those who wish to instruct mediators to assist with their disputes.
Parties may directly contact any mediator on the list using the specified email addresses and are encouraged to carry out their own research. Alternatively, if parties prefer the Ciarb DAS team to provide a recommendation by conducting the research and identifying mediators to meet the selection criteria, then the parties can follow the process and pay the fee as set out on Ciarb’s DAS web pages.
