Ciarb to launch report on the use and effectiveness of expert witness evidence

Ciarb will publish its report – Maximising the Effectiveness of Experts in International Arbitration – later this month, following a global industry survey and consultation period to identify how expert witness evidence is prepared, communicated, understood and used.   

The report, which details why expert evidence is most effective when tribunals take a more proactive, structured approach to expert witness input and engage expert witnesses early in the process, is intended as a reference point for improving how expert witness evidence is used in arbitral proceedings internationally.   

International working group CoChair, Pamela McDonald MCIArb, said: “Maximising the effectiveness of experts in arbitration is fundamental to ensuring that tribunals receive clear, reliable and timely evidence. This project is an important step toward raising global standards, strengthening communication between experts and counsel, and ultimately improving the quality of decision‑making in complex disputes.” 

Ciarb’s Deputy President, Michael Tonkin C.Arb FCIArb, is the other Co-Chair.  

The report’s launch will coincide with a webinar that Ciarb is hosting to discuss the key findings from the survey and the report, before our panel speakers explore actionable solutions.  

Panel speakers include Ciarb’s Senior Dispute Resolution Advisor (Arbitration) Aruna de Silva MCIArb, Pamela McDonald MCIArb, and Michael Tonkin C.Arb FCIArb, and members of the report’s working group, Abdul-Lateef Jinadu FCIArb and Domingos Fernando Refinetti FCIArb.
