Writing a clear, concise, unambiguous, and enforceable arbitration award is an essential skill for arbitrators. This on-demand course helps you develop your award writing skills through videos led by Dr Karen Akinci FCIArb and interactive activities covering three key stages: Technical Draft, Analytical Draft, and Final Draft.

By completing the course, you will learn to analyse facts and legal issues, prepare a final award, address costs and interest, provide adequate reasons, and apply your knowledge to a case study.

This course considers the technical matters of grammar, sentence structure and formatting, and ensures the award is clear, concise, and free from errors or ambiguities. It takes individuals through analysing the facts and legal issues in an arbitration, with a view to preparing an award. It is set out in three main parts, as there are normally three drafts of the award, and a scenario is included to apply the knowledge attained. Videos from an experienced tutor and arbitrator, Dr Karen Akinci FCIArb, are also included and there are a number of interactive activities to support the learning.

There are no entry requirements. The course is intended for candidates who:

  • are practitioners wishing to refresh their skills
  • are practitioners wanting to develop an arbitration practice
  • are interested in the field of ADR,
  • wish to learn more about ADR and its benefits to users


Candidates enrolling on any Ciarb course/assessment are required to ensure that their command of spoken and written English is adequate for the course/assessment for which they have applied. Ciarb does not require any evidence of this standard prior to enrolment on a course/assessment. However, it is the candidate's responsibility to ensure their English language skills are at a Professional Working Proficiency level, in order to meet the required standard when enrolling for any Ciarb course/assessment. It is recommended that candidates have achieved a standard that is, as a minimum, equivalent to the International English Language Testing System (IELTS) level 7 or a score of 94-101 in the Test of English as a Foreign Language (TOEFL) system. (Please note that we do not require an official IELTS or TOEFL result).

What are the learning outcomes?

On successful completion, you will effectively be able to:

  • Explain the importance of procedural history and the principles of the arbitration process leading to the preparation of the Final Award .
  • Evaluate relevant domestic arbitration law and Articles II and V of the New York Convention to avoid enforcement problems.
  • List the facts and legal issues in an arbitration scenario.
  • Identify the key component parts of an arbitral award.
  • Demonstrate reasoned decision making, grounded in procedural knowledge and relevant law.
  • Apply knowledge and skills to an arbitration scenario to produce a reasoned award that satisfies all technical requirements of an enforceable award, that stands up to scrutiny, including costs and interest.

What is covered in the Syllabus?

Through a mix of videos, case studies and interactive activities, you will explore the three main stages of Award Writing:

  • Technical Draft, usually written up before the hearing.
  • Analytical Draft, usually written up just after the Closing Statement or Post Hearing Briefs.
  • and the Final Draft, usually written up after any submissions on costs and to be published to the Institute or Parties.

How will I be assessed?

This course is not assessed. In order to receive a certificate of completion you must go through the entire content of the course this includes: watching the videos in full and completing all of the interactive exercises.

What happens when I register for the course?

Upon successful registration on the course, candidates will receive confirmation they are booked on the course.  Joining instructions and course materials will be available on LearnADR approximately 3 days after successfully booking and paying for the course.

What is LearnADR?

LearnADR is Ciarb's online learning platform.

 

Once you have purchased the course, you can access it by going to your dashboard and click on 'My Courses'. There you will find a red button that says, 'LearnADR'.

 

How long will I have access to LearnADR?

You will have access to LearnADR for 6 months from the date of enrolment.

What is Ciarb’s policy on cancellation of courses?

Ciarb reserves the right to cancel or change the date, venue or content of programmes and the names of speakers, lecturers and tutors.  Candidates will be provided with adequate notice of any change.  If Ciarb has to cancel a course, candidates will be provided with a full refund or the opportunity to transfer their registration to the next course.  Should a candidate wish to cancel/defer their registration of a course, notification must be received in writing to education@ciarb.org.  Deferral charges apply.  Please refer to the Fee Terms and Conditions for full details.
