What is Product Recall Disputes

The Health and Safety Executive (HSE) is a UK government executive responsible for the regulation and enforcement of workplace health, safety and welfare.

In Northern Ireland, The Health and Safety Executive for Northern Ireland (HSENI) is the executive responsible for the promotion and enforcement of health and safety at work standards in Northern Ireland.

The CIArb has been appointed as the dispute resolution service relating to recall notices served by the enforcing authority in respect of electrical equipment.

In the event the enforcing authority has notified the operator of an intention to serve a recall notice, the operator may at any time prior to the service of the recall notice require the authority (HSE, HSENI) to seek the advice of such person as the CIArb determines on matters such as non-compliance and whether issue of a recall notice would be proportionate.

Should the operator require the HSE, HSENI to seek advice from the CIArb, that operator is be responsible for the fees, costs and expenses of the CIArb to appointment the neutral and for the appointed neutral to advise the enforcing authority.
